Controls
All orders imply the buyer's unreserved acceptance of these terms and conditions of sale. Our supplies are always made subject to our general terms and conditions of sale, irrespective of our customers' general terms and conditions of purchase. Any derogation specified on the order form can only be considered as accepted if explicitly agreed by us.
The quantities entered on our delivery notes constitute justification of the quantity delivered and invoiced.
In the event of fortuitous events or force majeure, orders in progress may be suspended or executed late, without compensation or damages.
Price
The prices of the goods sold are those in force on the day the order is taken. Packit reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.
Transport
All our goods travel at the consignee's risk, even those sent carriage paid. It is the consignee's responsibility to make all reservations and to exercise any recourse against the carrier, in accordance with article 105 of the French Commercial Code.
In the event of damage, loss or delay in delivery, the purchaser must make reasoned reservations on the delivery note and confirm them to the carrier within 48 hours by registered letter with acknowledgement of receipt, failing which the claim will be rejected.
Deadlines
Deadlines are given as an indication only and are not binding on us: exceeding them will not give rise to compensation or penalties for late delivery.
Withdrawal periods
The customer has a period of 14 days from receipt of the products to exercise his right of withdrawal.
The customer must return the products without undue delay, and at the latest within 14 days following the communication by e-mail or telephone of his decision to withdraw.
The customer must return the product(s) concerned in their original packaging, including any instructions and/or accessories.
The customer is informed that he/she is still responsible for paying the cost of returning the products and that this cost will be deducted from the total amount refunded (the cost varies according to the weight of the parcel).
Items returned incomplete, spoiled or damaged due to mishandling by the Customer will not be reimbursed in full.
Portail Packit will inform the customer of the value of the compensation corresponding to the loss suffered.
Payments
In the event of non-payment by the agreed due date, the purchaser shall automatically incur default interest equal to the legal interest rate plus 4 points, without the need for any formal notice. Failure to pay an invoice by its due date, or the simple return of an unpaid bill, renders payment of all other invoices immediately due, even if they have given rise to bills of exchange already in circulation.
Payments must be made by cheque for all amounts under 160 euros. In the event of default on the part of the buyer (dissolution of a company, death, non-payment of an invoice on the due date) we reserve the right either to cancel orders, or to request guarantees in order to continue their execution.
Dispute
Any dispute, whatever the cause, shall be referred to the Commercial Court of BORDEAUX, which shall have exclusive jurisdiction, even in the event of warranty claims or multiple defendants, notwithstanding any covenants. This rule also applies to exploratory sales.
Thermolaquage
Garantie structure 5 ans SANS VESTUSTE
PACKIT garantit la solidité de l’assemblage mécanique du cadre du portail par tenons mortaises pour une durée de 5 ans dans les conditions normales d’utilisation et d’entretien.
Les accessoires, pièces de fonderie sont garanties pour une durée de 1 an.
Exclusion :
– Détérioration causée par le transport
– Détérioration causée à la pose
– Un accident extérieur,
– L’usure normale
– Le défaut ou le manque d’entretien
– Une motorisation non conforme
Garantie thermolaquage 5 ans
Les profils aluminium thermolaqués sont garantis pour une durée de 5 ans contre
– Le décollement
– L’écaillage
– Le cloquage
– La corrosion filiforme (la corrosion issue de couple galvanique qui résulterait d’une pose non conforme est exclue)
Spécificités :
– Les accessoires
– La garantie réduite à 2 ans en cas d’implantation à moins de 500 m d’une côte
– La garantie est exclue en cas d’implantation à moins de 100 m d’une côte
La garantie ne couvre pas le vieillissement normal du thermolaquage : la perte de brillance, la dépigmentation naturelle, l’évolution de teinte normale, le farinage de revêtement…
La décoloration des matériaux résultant des effets de leur exploitation, des intempéries et/ou de l’environnement, n’est pas un vice et ne bénéficie donc pas de garantie.
Le thermolaquage est garanti contre toute évolution de teinte ou de brillance pour des éléments qui soumis à même exposition (solaire, pluie) dans la même ambiance, ne s’effectuerait pas de manière lente et homogène tel que les Directives Qualicoat en vigueur à la date de fabrication du chantier les définissent.
Exclusion :
– Les dégradations dues à un usage anormal du produit
– Les dégradations dues aux impacts, chocs, rayures, déformation…
– Les dégradations dues aux éléments extérieurs : la stagnation de l’eau, le manque ou le défaut d’entretien, l’entretien non conforme, l’utilisation de produits au contact duquel contact es surfaces thermolaquées ne résisteraient pas.
– L’inobservation des règles d’entretien, de stockage, montage sur chantier
– L’exposition à des agents agressifs : l’exposition saline, atmosphère corrosives (rejets industriels, engrais, pesticides…), produits d’entretien inadaptés au thermolaquage, l’abrasion par le sable
PACKIT présentera au client un devis de réparation sur lequel une partie demeurera à la charge de PACKIT en fonction du tableau de vétusté ci-dessous.

Reservation of title
CLMJJ remains the owner of the goods delivered until full payment of the price and any incidental costs. Nevertheless, the purchaser assumes full responsibility for the goods as soon as they are delivered.
